Opinion by Bro. W. E. P. Anderson, of No. 107.
This is an appeal on the part of Brother William Eller from the
action of Boyd Lodge, which resulted in his expulsion.
On August 23rd, 1906, complaint was properly made by a member of
said lodge that he had reason to believe that Bro. Wm. Eller has been
guilty of conduct unbecoming an Odd Fellow and requesting that the
matter be investigated, etc.
A committee was duly appointed by the Noble Grand to investigate
the charges. On September, 1906, a vote of the Lodge was taken which
resulted as follows: 4 for expulsion and 2 for acquittal. On October
4th, 1906, the appeal of Brother Eller was read and allowed.
The foregoing is all of the proceedings in this case shown by a
transcript of the records of said Lodge.
No report is shown to have been made by the investigating com-
mittee embodying the cliarges and specifications upon which the
Brother was to be tried.

No copy of the charges and specifications under the seal of the
Lodge is shown to have been furnished him, or that he was cited to
appear for trial.
No opportunity is shown to have been given him to plead guilty or
not guilty.
No commissioner is shown to have been appointed or obligated to
take tie testimony in the case.
There is nothing either in the record or among the papers fur-
nished this committee purporting to be the testimony taken in said
case.
Numerous other omissions and irregularities could probably be
pointed out, but the above are ample to require us to sustain the appeal
of Bro. Eller. It is therefore ordered that said appeal be and is hereby
sustained and the Lodge is instructed to reinstate Bro. Wm. Eller to
membership without prejudice.

Opinion by Bro. M. P. Berry, of No. 412.
This is an appeal taken by thirteen members of Stonefort Lodge
No. 731, I. 0. 0. F. from the action of the Lodge in refusing to sustain
the charges against Brother H. L. Webber under the evidence sub-
mitted to it in the case against him.
We have carefully read the record and all the evidence in the
case. There were fourteen members of the Lodge voted to sustain the
charges and twelve voted not to sustain them. The opinion of the
members of the Lodge, all of whom live in the community and know
the witnesses personally, seem to have been about equally divided on
the question.
While the committee is not entirely satisfied with the decision of
the Lodge, yet the evidence is so conflicting and so much of it hearsay,
that we do not feel justified in disturbing the action of the Lodge and
sending the case back and thus compel the Lodge to go over the matter
again.
The record discloses the fact that the husband and wife, that were
for a time separated by sensational reports, are now living together

again, and we are unable to see where any good can result from again
going over this evidence. For obvious reasons we refrain from review-
ing the evidence or even stating the facts. There is no important
question of law involved in the case. It is solely a question of fact,
and that having been fully passed upon by the Lodge, so far as we can
see, we do not feel justified in reversing the action of the Lodge.
The appeal is therefore dismissed.

This case comes to us by appeal of Brother C. E. Bennett from the
action of the above Lodge in "striking his name from the roll of the
Lodge." The trouble in this matter arose between two members of the
Lodge out of their business relations, and out of the refusal of Brother
Bennett to pay a debt which he disputed, and claimed to have a legal
defense. A court of law is the proper tribunal to settle all disputes of
that kind and not the Lodge.
The specifications in this case fail to show any cause of action
against Brother Bennett. They do not state how nor when nor where
he was guilty of fraud. The last one clearly shows the trouble grew
out of a failure to collect a debt. The evidence shows simply a disputed
account between two Brothers, and discloses no proof of fraud, and the
Lodge should have dismissed the matter.
The appeal of Brother Bennett is sustained and the action of the
Lodge is reversed and the Lodge is directed to reinstate Brother Ben-
nett to full membership.

Brother Miller was a member of Forest Lodge No. 255 in good and
regular standing. He owned a home and leased it to a family with
whom he boarded until a short time before his illness, out of which this
case grows. The family having removed, Brother Miller occupied his
home alone, when on June 16, 1906, he was stricken down with a very
severe attack of iliosecal impaction. Dr. Davis was called as attend-
ing physician. So serious was the attack that for three or four days
the attending physician made six to eight visits each day. About a
week after the first attack, the illness developed into typhoid fever, so
severe in its character that the attending physician pronounced it ex-
traordinary. Three weeks later, when the fever was at its crisis, a
visitor told the patient that he had typhoid fever. The result was
a relapse and another three weeks' run of the fever, which the physi-
cian believed was wholly due to the statement made by the visitor to
the patient.
Brother Miller was confined to his home from June 16th to October
1st, and his condition was considered dangerous until September 20th.
The Lodge paid sick benefits until October 13th, when Brother Miller,
at his own suggestion, though not able to resume work, was declared
off the sick list.
Brother S. F. Merrifield, the Noble Grand, appointed Brother G. W.
Hoover to look after Brother Miller's wants. Brother Hoover did not
act as nurse at any time, but remained at Brother Miller's home at night
and rendered some assistance to the nurses during the day time. For
such services, from June 19th to July 14th, the Lodge paid Brother
Hoover Thirty-eight Dollars ($38.00). He continued to look after the
wants of Brother Miller until his recovery, but made no charge for
services rendered after July 14th.
The controversy in this case arises over the question of the liability
of Forest Lodge for the nurse hire. Part of the nurse hire was paid by
the Lodge. During the illness of Brother Miller a notice was posted
at the door of his home by direction of the attending physician, deny-
ing entrance to visitors. The nurse testified that, notwithstanding this
notice, he usually allowed members of the Lodge, without restriction,
to visit the patient. The bill for nurse hire, $22.50 of which was paid
by Brother Miller to Miss Cunningham, and $115.50 of which was paid
by Brother Miller to Charles Ransey, making $138.00, was presented

by Brother Miller to the Lodge, and by the Lodge referred to the
finance committee. The finance committee reported recommending the
payment of the bill. The Lodge disapproved the report of the com-
mittee and refused payment. From this action of the Lodge Brother
Miller appealed.
The evidence taken on behalf of the Lodge all shows that the
opposition within the Lodge to the payment of the bill developed out
of alleged statements derogatory to the Lodge membership made by
the attending physician. The question of legal rights and obligations
appears to have been almost entirely lost sight of. There is some
evidence tending to show that the physician in charge did make un-
complimentary remarks touching the membership of the Lodge. If such
remarks were made, they undoubtedly were made in a moment of irri-
tation growing out of the fact that the brothers were allowed, without
restriction, to visit the patient, in violation of the physician's positive
orders, and no doubt from the view point of the physician, to the great
detriment of the patient. In cases of serious illness absolute quiet is
one of the most important essentials of recovery, and the judgment
of the attending physician touching the necessity of the rigid enforce-
ment of the rule against visitation of the patient, ought to be accepted
as final and cheerfully complied with.
This case is not entirely free from doubt, but we are of the opinion
that, under all the circumstances shown in evidence, the bill ought to
