tigation has been received, requesting that I would furnish you a
statement of the amount of money received by the several acting
commissioners of internal improvement up to the 21st FebrvHiry*
also a statement of the claims presented for audit and not allowed
and the reason for not allowing them, and also the facts toudung
the disagrcemrnt that has existed hi regard to the board of inter*
ttial improvement.
In compliance with your request the following statement is sub>
mitted, and as near as I can rec(»llect, from the length of iime that
has elapsed, contains the fiicti which led to that disagreement, re-
serving, however, all inaccuracies as respects date and the ar-
langement of the circumstances as they occurred.
By the act of the 6th April, 1838, the auditing of accounts for
disbursements of money on the several works otintemal improve-
ment, dev<4ved on ihe Auditor General, which called my imme-
diate attention to the examination of the several acts that created
the office of Auditor and his several duties.
The office of the Auditor was created by an act of the lerritonr
of Michigan, approved 5ih November, 1829, page 177, 1st and
3d sections, bound vol., whereby it is made the imperative duty
of the Auditor to state nil accounts, and examine and liquidate the
claims of all persons against. &c. The constitution of the state
of Michigan provides that there shall be an AuditortSenerai ap-
pointed, and oy the act of the legislature approved 19th February,
1836, pages 48 and 44, 1st and 2d seotioos, it is made the duty of
the Auditor General to perform and exercise the same duties and
functions which were required to be performed by the Auditor of
the late territory. The act of the Oth April. 1836. taken ra
connection with the several acts above quoted, brought me to the

tioiiedt and the extent of the duties growing out of. the act of the
6th April, ti*gether With the very large and imniense amount of

tem.d HnprovQiiient, I applied to the Hon. William Woodbfidge,
who was chairman of the committee on finance during the winter
session of the legislature of 1838, and a profound jurist, for his
opinion of the act of the 6th April, 1838, and the intention of the
legislature, in connection with the several acts quoted before rela*
tive to the duties, of the Auditor, who in a written communication
to me gave me his yiews on the aubjecti a copy of which is bere^
unto annexed and making part of this statement.
Immediately after the organisation of the board of internal im-
provementy the late Hiram Alden^ subscribing hinuielf auditor of
the board, comnfienced drawing warrants on the treuury for d^*
inages awarded by special commissioners to certain individuals
along the central railroad, pursuant to an act of the 5th April,
and also for labor on the said road ; ihese warrants were in aU
most every case rejected by me as illegal, but received them as
evidence of indebtedness, and drew warrants on the treasury in
favor of the several claimants, and in some cases warrants were
S'ven on the certificate of the Secretary of State ; among the
tter was the cloim of Conrad Ten Eyck lor t^'sOOO.
In this stale of things, the Board considering it grievous that no
respect was paid to the warrants of their auditor, appointed a
committee to know the reason why I refused to countersign the
warrants of the auditor; my reply was, tliat the act of the 6th
April did not recognize an autiit(»r of their board to audit ac-
counts and draw warrants on the treasury. The committee then
informed me that tl)9 written opinion of the Attorney General hud
been obtained on the several interrogatories propounded by the
board, which was handed me to read, and after reading bis opin*
ion, the oonomittee was informed that althotigh I respected bis
opinion, yet I did not consider myseh bound by it ; see act ap*
proved 26th December, 1834, pages 26 and 27, section first,
pamphlet laws of the territory of Michigan. At this interview
with the committee, I was inft»rmed that the board had a claim
against Conrad Ten Eyck, which had not been deducted from his
claim, and in order to obviate any further difficulty of a similar
nature, I requested them to furnish me with a certified schedule
of the names of the claimants, together with the amount due
them respectively fir damages* wh(ch they peremptorily refused.
The auditor of the board nevertheless continued auditing accounts
and drawing warrants on the treasury, which in every instance I

After L. B. Mizner resif^ned, his sucoesaor, Mr* Aktem applied
for a further advance to be dfsburaed on ike eontrai railroad, to
wit : 95,000. Until the first advance of #5,00a was r^^rlv
accounted for, I refused making any further advanoet. Mr. aU
den then stated that the work must stop, nnd complained to hk
excellency Got. Mason, with whom 1 had an interview, and after
consulting with him it was thought advisable to mako a fanfatr
advance to enable Mr. Alden to progress in the work. As a
number of claims for labor remained unsettled by the late board,
they vi^re presented for allowance under the act of April mh, but
being totally unacquainted with the justness of the clairoa, or
wheSier they had been paid bef()re or not, I required the affidavit
of the engineer or the claim certified by the acting Commissiooery
which I considered the only safe plan i could atkipt to prevent
any imposition that might be attempted to be practised. This
eourae appeared to give considerable dissatisfiBction to tlie boar4
and was communicated to the Governor, who requested my nt*
tendance with a view of reconciliation or neutralizing matters^
After some remarks made by the* board and by myself, I then
informed the board that I should rigorouoly pursue the coorae I
bad adopted in aHc»wing any datm ; further, die board passed a
resolution and ordered that the sum of #10,000 be drawn from
the treasury and placed in the hands of Doctor AMen, who was
authorised by the board to pay individultis along the central rail-
road in anticipation of damages. This order I refused paying as
the act of ^h of April did not authorize advances ikiade for this
purpose.

. On or about the 11th September hist» James B. Huat, & H.
Lolhrop and L. B. Mizoer caane to the oiBce* Mr. Hunt pre*
sented a resolution of the board, accoakpaoied with their order, (ot
1^7,788 4a, and required a warrant on the treasury for that
amount, pursuant to the order. This amount included bis claim
tos WModi before mentioned, another for E. Cody, and a claim fur
Smith, an engineer. Mr. Misoer pioduced the voucher of B.
Cody, and inquired whether at the time of its being audited it was
made known that tlie account had been allowed by the iormer or
late hosrd, and was answered in the oegativc.
Mr. Mizner elected to the elaim being allowed.
Mr. Lothrop and Mr. Hunt entered into some explanation re-
ladve to^ the claim of Mr. Smith, the engineer, and the clahn was
taken by Mr. Burt, with a view of makin'j some further inquiry
into the case, as Mr. Smith was engineer on that part of the work
under his Hiunodiale charge. I refused comi^lying with tde order
of the board, and did not issue a warrant for the lollowing rai^
sons, viz :
ist. There was not a majority of the board without the signa^
lure and vote of Mr. Hunt, who voted on a claim in which he
was altogether interested.
2d. It embraced an item for a large n mount of wood purchased,
an ex^nse Incident to the running the cars, and for which no pro*
vision was made by law.
3d. The claim oY EL Cody for (1,254 13, constitutes part of
the amount, and had already been paid to the claimant by the late
board.
4Au Aa toasidbnibia advances had been made James B^ Hunt
by the late board, (as I was in£iniied,) had not been satisfactorily
adjusted, and being fully convinced that my refusing to give a
warrant for the above amount would necessarily lead to an b-
vestigation of his accounts by the legislature, that relief would
be aflbrded him if he was entitled thereto, whereas, if otherwise,
the state would suflfer loss to that amount drawn from the trea-
sury.

The above claim wat alfowed for the amoimt of rent, but the
breaking of glass and luss of articles were not allowed, ns I did
not a>nsider (he slate liable for breakage and loss of limpeffty by
reason of the neglect of engineers, receiving large 8ahiries»*aod
who ought to have paid the damages The board, nevertheieasy
by their auditor, illegally allowed the whole claim, and drew •
warrant for the amount.
Joel A. Collyer, for services and damage to his horse and har-
ness while employed in bringing in the passenger car frona Dear-
born to Detroit on the night of the 2d February, 1888.
This claim, when presented for audit, was composed of tuo
items, one for the use of a horse, and the other for damages to fait
horse and harness. The claim for the use of the horse was ad-
mitted, but for damages I would not allow.
The account was presented to the board and ordered to be
paid, to wit : twenty-five dollars.

M. W. Baldwin of Pit!sbur/jh, for materials forwarded from
thence on account of the state, amountint? to 81,251 96, including
•110 50 interest, and claimed the difference in exchange between
citv money and Philadelphia. Mr. Baldwin stated that his visit
to t)etroit was not for the express purpose of collecting the debt
due him by the slate, but had other business to attend to. These
facts coming to my knowledge, I informed him that the money
was ready for him. (to wit: specie,) and w*»uld not, thereforet
allow him the difference in exchange which he claimed. His ac-
count was paid on the lOlh September ; ten days after, the board
allowed his account for the difference of exchange, to wit : #25 04,
and ordered it to be paid.
