OPENING STATEMENT OF SENATOR AKAKA

Senator Akaka. Good afternoon, ladies and gentlemen. The Com-
mittee will come to order.

The Chairman of the Governmental Affairs Committee, Senator
Glenn, has asked me to chair today's full Committee hearing on the
nomination of Harvey G. Ryland to be Deputy Director of the Fed-
eral Emergency Management Agency.

This position has been vacant for nearly 2 years, which has im-
posed a heavy administrative burden on Director James Lee Witt
and other top FEMA managers. For an agency which has principal
responsibility for responding to the dozens of major emergencies
and disasters that take place each year, the absence of a day- to-
day administrator has been a severe handicap. The President's
nomination of a Deputy Director has thus been eagerly awaited by
both FEMA and the Committee.

A native of Fort Lauderdale, Mr. Ryland graduated from Florida
State University with bachelor's and master's degrees in engineer-
ing science. Mr. Ryland began his career researching crew safety
for the Apollo Moon flight program. From 1976 to 1987, he founded
and operated a research company specializing in the analysis and
design of public safety and emergency management systems. He
later served as a consultant to local, State, and Federal clients on
emergency management issues.

From 1989 to 1993, he was Executive Director of the Central
United States Earthquake Consortium, a Federal-State partnership
which develops and implements programs in earthquake education,
mitigation, and response. Since April 1993, Mr. Ryland has been a
senior policy advisor to FEMA Director Witt.

It is clear that, like Director Witt, Mr. Ryland is vastly experi-
enced in the field of emergency management. If he is confirmed, it
will mark the first time that FEMA's top two officials have been

emergency management professionals. This is a welcome develop-
ment for an agency that, in the past, has been accused of being top-
heavy with inexperienced political appointees.

The nominee comes to FEMA at an especially important time for
the agency. I have already referred to the historical absence of pro-
fessionals in the top leadership positions. Other questions have
been raised about the timeliness and appropriateness of FEMA's
response to disasters as well as its relationship with local and
State emergency management authorities.

Additionally, a number of recent catastrophic disasters which
have occurred in rapid succession has imposed a strain on the Fed-
eral budget, impelling Congress to reconsider the manner in which
it finances disaster programs. And the end of the cold war has
forced a refocusing of FEMA's mission from an emphasis on nu-
clear attack preparedness to an all-hazards approach.

The Deputy Director will be required to work closely with the Di-
rector in guiding the agency through the many changes in its mis-
sion and structure that must inevitably come about in FEMA if it
is to remain a useful, viable organization.

I strongly believe that Harvey Ryland has the skills and experi-
ence to fulfill this role. He has a difficult challenge ahead of him,
but I am confident that he will meet or exceed the high expecta-
tions we have for him.

I would like to now welcome and recognize three distinguished
Members of the Senate, Senator Bob Graham, Senator Harlan
Mathews, and we expect Senator Sasser. They very much would
like to have a part in introducing you to the Committee.

Senator Graham, I believe you had asked to go first. You have
another appointment to go to, so we certainly want to have your
statement here and would ask you to proceed.

TESTIMONY OF HON. BOB GRAHAM, 1 U.S. SENATOR FROM THE

STATE OF FLORIDA

Senator Graham. Thank you very much, Mr. Chairman. I both
appreciate your courtesies and also I heard your remarks as I was
entering the room and I second the high opinion that you have of
Mr. Ryland and his qualifications for this important position as the
Deputy Director of the Federal Emergency Management Agency.

Mr. Chairman, in deference to your schedule, I have a lengthy
statement which I would like to offer for the record.

Senator Akaka. Without objection, it will be placed in the record.

Senator Graham. If I could just make a few comments, Mr.
Ryland is a distinguished Floridian and we are very proud to call
him a citizen of our State. He has lived in virtually every region
of Florida. He was born in Fort Lauderdale. He graduated from
Leon High School, and I might say, Mr. Ryland, that four of my
daughters graduated from Leon High School, so I am particularly
impressed with that.

In 1962, Harvey graduated from Florida State University with
an engineering degree, and in 1963 he received his master's degree
from FSU in engineering science.

His current position is as senior policy advisor to FEMA Director
James Lee Witt. In this position, Harvey has developed broad ex-
pertise in emergency management areas. He brings to that position
28 years of experience in emergency management, public safety,
having served both the public and private sector working with
local, State, and Federal officials.

Let me say, Mr. Chairman, one of the most impressive aspects
of James Lee Witt's administration of FEMA has been that he has
brought into the agency people who actually wanted to serve in
areas of emergency management, safety, planning to mitigate fu-
ture emergencies, and that strong quality of personnel with whom
he has surrounded himself has demonstrated itself time after time
in the agency's ability to respond effectively to the needs of Ameri-
cans at a high level of crisis.

I believe that Mr. Ryland will do an outstanding service should
he be confirmed in his new position as Deputy Director. I commend
him to you fully and hope that there will be a prompt and over-
whelming confirmation of his service in this position.

Senator AKAKA. Thank you very much, Senator Graham. I will
tell you that we are going to try to move it as quickly as we can.
I thank you for your statement.

Now I would like to call on another distinguished Senator, Sen-
ator Mathews.

TESTIMONY OF THE HON. HARLAN MATHEWS, 1 U.S. SENATOR
FROM THE STATE OF TENNESSEE

Senator MATHEWS. Thank you, Mr. Chairman.

I, too, feel this is a great honor to be able to be here today and
to join my colleagues from Florida and my senior colleague from
Tennessee in presenting Mr. Ryland's credentials to this Commit-

tee.

Mr. Chairman, you and I, our States have shared some experi-
ences that bring us closer to the situation that we have before us
today. It gives us a better appreciation of the work that needs to
be done. I am certain that we are concerned about the qualifica-
tions of those who will be doing it.

In the short period of time that I have been in the Senate, we
have experienced in my State, and I am familiar with some of the
things that happened in yours and others, emergencies of just
about every character. One of the first things we were faced with
was a tornado in the Eastern portion of our State one afternoon.
It just literally took a town and scrambled it, as you would eggs.
It wasn't too long after that until the flood waters hit generally in
the same area. Over the past two winters, each one we have experi-
enced ice storms that left portions of our State without power and
made transportation almost impossible.

I relate these things to say that we know what FEMA is in Ten-
nessee. We know what TEMA is, which is our State version of that.
We appreciate the job that the people who are in these two agen-
cies do. We appreciate the capabilities. Were it not for them, there
would be a lot of our citizens who would have suffered much, much
more than that which they have.

So with this background, Mr. Chairman, I would like to take just
a few moments to introduce a friend, a fellow Tennessean, and a
public servant. We have talked about Harvey and his role here,
and I want you to know that I am pleased to join and support
President Clinton in his nomination of Mr. Ryland. I join with him
in asking that we push this nomination forward with all rapidity.

I do know that we are approaching some seasons when some
other emergencies are more likely to happen than has been true in
the last couple of months and we want to make sure that we are
prepared.

In the capacity in which Mr. Ryland is offering his services, he
has amply demonstrated his ability to tackle those job require-
ments. Most notably, recently he was the executive director of the
Central United States Earthquake Consortium before assuming his
current duties. This consortium is responsible for emergency pre-
paredness and reduction of seismic risk for 15 American States.

During Mr. Ryland's 4 years at the consortium's headquarters in
Memphis, Tennessee, I was greatly impressed by his work with the
Tennessee Emergency Management Agency. He showed insight in
anticipating the kinds of catastrophic events calling for large-scale
action, and he proved himself highly capable at coordinating the in-
volvement of disparate Federal, State, and regional agencies.

This, Mr. Chairman, is precisely the kind of comprehensive and
hands-on experience a senior executive at FEMA should bring to
the job.

In addition, Mr. Chairman, I point to Mr. Ryland's single con-
tributions to the field of emergency preparedness and response. He
has been in the forefront of public education efforts to make Ameri-
cans aware of catastrophic risks to their families, their homes, and
their businesses . He has been a leader in the development of
emergency medical services.

Quite simply, Mr. Chairman, Harvey G. Ryland is a capable,
committed, experienced, and respected professional in a complex
and important field. He is fully qualified to be Deputy Director of
an Agency that all Americans depend on in times of worst crisis.
I urge you to forward his nomination to the full Senate.

you for taking time to come here from your busy schedule to testify
and introduce and support the nominee.

Senator Mathews. Mr. Chairman, if I might note, I abbreviated
my statement also and would like to submit the full statement for
the record.

Senator Mathews. Thank you.

Senator Akaka. On behalf of the Chairman Glenn and the rest
of the Committee, I would like now to formally welcome the nomi-
nee, Harvey Ryland, to this confirmation hearing and also to recog-
nize the Director of FEMA, James Lee Witt.

At this time, let me note for the record that Committee rules
mandate that an inquiry be conducted into each nominee's experi-
ence, qualifications, and suitability to serve in the position for
which the President has nominated this individual.



In this regard, the Committee has received from the nominee a
financial statement and detailed information on educational, em-
ployment, and professional accomplishments. The nominee has also
responded in writing to a number of prehearing questions. Copies
of this biographical information and responses to prehearing ques-
tions will be placed in the record as part of this hearing. The nomi-
nee's financial statement will be available for public inspection in
the Committee office.

The Committee staff has interviewed the nominee prior to to-
day's hearing. In addition, the staff has reviewed opinion letters re-
garding the nominee from both the Office of Government Ethics
and the designated agency ethics offices. Finally, Senator Glenn
and Senator Roth, the Chairman and ranking member, respec-
tively, of this Committee, will soon review the FBI background in-
vestigation reports on the nominee.

Committee rules also require that the nominee be under oath
while testifying on all matters relating to his suitability for office,
including policies and programs which he will pursue while in his
position.

I would now ask the nominee to come forward, Mr. Ryland.

Mr. Ryland. Yes, I do.

Mr. Ryland, it is customary for the Committee to recognize fam-
ily members, friends, or other individuals who may be special to
the nominee. Is there anyone that you wish to introduce at this

time?

Mr. Ryland. Yes, Mr. Chairman. I am pleased to introduce my
very special friend and strong supporter, Lisa Stephenson. Also, ]
have two wonderful daughters who are in graduate school and
could not be with me today.

Senator Akaka. Thank you, Mr. Ryland.

The Committee extends to you the warm welcome of the Commit-
tee, Ms. Stephenson. I know you must be very proud of Mr. Ryland
and I know his daughters are, too, at this moment.

Mr. Ryland, at this time, you may proceed with your statement.

TESTIMONY OF HARVEY G. RYLAND, 1 NOMINEE TO BE DEPUTY
DIRECTOR, FEDERAL EMERGENCY MANAGEMENT AGENCY

Mr. Ryland. Thank you, Mr. Chairman.

Before I begin my statement, I would like to thank Senators Gra-
ham and Mathews for their generous introductions and thank Sen-
ator Mathews for remaining to sit with me during this hearing.

I will summarize my statement and ask that the entire state-
ment be included in the record.

Senator Akaka. Without objection, it will be included in the
record.

Mr. Ryland. It is indeed an honor to have been nominated by
President Clinton for the position of Deputy Director of the Federal

Emergency Management Agency. I am confident that my 28 years
of emergency management experience have prepared me to fill this
position.

I am honored, as well, to appear before this Committee. Your
support for Director Witt and your encouragement to the Agency
as a whole are very important to the many dedicated employees at
FEMA.

I think that the mission of FEMA is perhaps the most noble serv-
ice in Washington. It is about helping people. It is about helping
people when they need help the most, when they are suffering as
a result of a natural catastrophe like Hurricane Iniki, which dev-
astated the people of your home state.

In April 1993, Director Witt asked me to work with him as his
senior policy advisor, an invitation that I accepted with enthusiasm
and high expectations. These expectations have been more than
met because I have been able to work with Director Witt to imple-
ment the renewal of FEMA. This renewal has included articulating
a new vision for protecting people and their property from disas-
ters; establishing a corresponding mission statement for the agen-
cy; implementing goals that will make the vision a reality; and de-
veloping a new organizational structure for FEMA.

The renewal has already changed the entire culture and percep-
tion of emergency management in the United States. Director Witt
has refocused the mission of the Agency on risk-based all-hazard
emergency management, including fire protection.

If confirmed, I believe that the most valuable contribution I could
make as his Deputy would be to assist him in continuing to estab-
lish overall policies to achieve his major goals and accomplish his
vision.

I would like to use the remainder of my statement to discuss this
vision and the importance of continuing to take those actions that
will ensure its accomplishment.

Our first and foremost responsibility is the health and safety of
the American people. We must do everything possible to ensure
that people of the United States know what to do before, during,
and after a disaster to protect themselves and their families. An in-
formed public is a safer public.

Second, we must think carefully about where structures are lo-
cated. New structures should be located out of high-risk areas such
as flood plains, brush fire zones, and sites with poor soil conditions.
We should continue to relocate, elevate, and retrofit as many exist-
ing structures as possible to reduce risks. Last fall, the Congress
gave FEMA the authority and resources to make dramatic mitiga-
tion improvements for existing structures through property ele-
vation and relocation. We are working hard to successfully imple-
ment this program.

Third, we must think carefully about how structures are built,
including costly infrastructure systems. They must be built accord-
ing to improved and strongly-enforced codes which provide for
structural and nonstructural disaster mitigation based upon the
risks in a particular area.

Finally, we must work closely with governments at all levels and
with private organizations to have in place proven, effective plans,
necessary resources, and rigorous training for disaster response.



Mr. Chairman, you, the President, FEMA, its constituent groups,
and the American people can and must change emergency manage-
ment in this country. We must not just reorganize. We must
reinvent the business.

Director Witt has set about that task and the results to date are
very exciting. For example, FEMA has made significant advances
in mitigation to protect people from future disasters, and in recent
disasters, we have been able to get help to victims much more
quickly than ever before.

But this is just the beginning. There is still much that we must
do, and I want to be a principal part of that activity. I ask that
you allow me the opportunity to serve FEMA in the critical position
of Deputy Director of the Agency.

Mr. Chairman, I hope that the next time I see you it will not be
on the beaches of Hawaii following a disaster but rather reporting
to you on how the effects of disasters in Hawaii and all other parts
of the country have been reduced as a result of the accomplishment
of the new vision for emergency management in the United States.

Thank you for the opportunity to appear before this Committee.
If confirmed, I would be honored to serve Director Witt, President
Clinton, and you as the Deputy Director of FEMA. Now I would be
pleased to answer any questions that you might have.

Senator Akaka. Thank you for your eloquent statement and your
vision, Mr. Ryland.

At the outset, I have several questions that I am required by
Committee rules to ask. Is there anything that you are aware of
in your background that might present a conflict of interest with
the duties of the office to which you have been nominated?

Mr. Ryland. No, Mr. Chairman.

Senator Akaka. Do you know of any reason, personal or other-
wise, that would in any way prevent you from fully and honorably
discharging the responsibilities of the office to which you have been
nominated?

Mr. Ryland. No, sir.

Senator Akaka. If confirmed, do you agree without reservation to
appear and to testify before any duly constituted Committee of the
Congress?

Mr. Ryland. Yes, I agree.

Senator Akaka. Thank you, Mr. Ryland. Now we will proceed to
other questions.

Before I do that, I want to enter into the record a statement from
the ranking Member, Senator Roth, for the hearing record.

PREPARED STATEMENT OF SENATOR ROTH

I would like to congratulate you on your nomination and on your efforts in work-
ing with several fire and emergency service organizations to develop the "Emergency
Management Information Network" (EMIN), in a partnership effort between FEMA
and the Fire Service. It is an important step towards the future.

have been advised by State Fire Commissioner Ed McCormick of Delaware, a
member of the Executive Board of EMIN, of your interest and support of a single
Computer Network for all emergency services and emergency management entities
across the country.

The first responders to an emergency need a source of information on a timely
basis for general information needs, training, fire simulations, and, for use as a com-
mand tool.

Could you explain for the record how you envision this network working, and the
support you are giving towards this project? I would also be interested in your com-

ments regarding a like project you were involved with in earthquake management
several years ago.

Senator Akaka. Mr. Ryland, as I said, your statement was elo-
quent. I am glad you included in it a vision for FEMA. I also must
tell you that when Director Witt appeared before the Committee for
his confirmation, he also had visions. I look upon your visions as
something that is needed for our country, for its health and safety.

The fourth statement you made was working with all levels of
government. I tell you that in Hawaii, this certainly was true with
FEMA. FEMA there worked with all levels of government and
worked very, very well. So I know that this can happen with your
efforts.

Mr. Ryland. Thank you, Mr. Chairman.

Senator Akaka. What is your view of the duties and functions of
the Deputy Director?

Mr. Ryland. Director Witt and I have discussed this issue and
have reached the following conclusion with regard to the division
of duties. My functions will primarily be oriented internally to the
agency. I will be the Chief Operating Officer. I will also be pri-
marily concerned with the long-range planning or strategic plan-
ning for the Agency and continuing to implement the renewal of
FEMA.

Director Witt will have primary responsibility for responding to
disasters and I will assist him in this area as he requests, but pri-
marily my focus will be internal.

Senator Akaka. What is your general philosophy of management
or your management style?

Mr. Ryland. Mr. Chairman, the management philosophy that I
