after notice, as aforcsaid, he having been required to do so by
a notice in writing signed by the person or persons
authorized to preside at such meeting or election,

workhouse of such union, he shall, on being con-
victed thereof before any two or more Justices of
the Peace, forfeit and pay any sum not exceeding

and such Clerk of the Guardians of each union as and any ad-

MMsn Act, An Act to make better provision for the Paving,
Lighting, Draining, Cleansing, Supplying with
Water, and Regulation of Towns in Ireland,
[lOth August, 1854.]



1854.



§ 7 defines the classes of persons who may
vote at the meeting to be held in any city or town
to consider whether the provisions of the Act
shall be carried into execution in such city or
town — ^the right to vote being made dependent
upon the poor law valuation and rating, and then
proceeds as follows : —

Such right of voting to be evidenced by the
rate book of the union, which the Clerk of the
union is hereby required to produce at such meet-
ing ; and if any controversy shall arise at any such
meeting as to the qualification or right of voting
of any person claiming to vote or to be qualified,
such controversy shall be determined by the per-
son or persons, as the case may be, presiding at
such meeting, by reference to the rate book,
which the Clerk of the union is hereby required
to produce at such meeting.

§ 22 relates to the qualification of voters at
elections of Commissioners under the Act — ^the
qualification being founded on poor law valuation
and rating ; the non-payment of poor rates, Grand
Jury rates, or local rates which have become pay-
able six months before the election being a dis-
qualification ; and then proceeds as follows : —

And of the payment or non-payment of such
rate, a receipt, certificate, or certified list imder
the hand of the Collector of poor rate, the barony
Collector, and the Collector under any local Act
in force in the city or town, shall for such purpose
be deemed sufficient evidence, and which certifi-
cate or certified list such Collectors and barony
Constables are hereby required to furnish to the
person or persons presiding at such election ; and

if any controversy shall arise at such meeting as ^' * \o3^'*^'
to the qualification or right to vote of any person Tomes
claiming to vote or to be qualified, such contro- ^^act

rate book, which the Clerk of the imion is hereby
required to produce at such meeting.

§ 61 requires the Clerk of the union, on
the requisition of the Commissioners, to produce
the rate book of the imion, and the Commis-
sioners are annually to cause to be made a book
of assessment, showing certain particulars relating
to all the premises in the town, from the last
assessment for poor rates.



4. PAKLTAMENTARY MANCHISE ACTS.



The extracts fix)m the Acts relating to the
Parliamentary Franchise in Ireland, which
are given below, are limited to those provi-
sions of the Acts which affect the rating under
the Irish Poor Relief Acts, or the duties of
any of the poor law officers, a brief reference
being made to some other of the provisions
of the Franchise Acts where necessary for
connexion or clearness.

1850, ' tries (under the 2nd <fe 3rd Wm. 4, c. 88), exclud-
ing persons registered in respect of qualifications
not requiring actual occupation, and to cause
copies of the register for each barony in the county
to be printed on or before the 1st of June in each
year after the year 1851. The 16th section re-
quires the Clerk of the Peace, on or before the
9th September, 1850, and on or before the 1st
June in each year after the year 1851 to deliver to
the Clerk of each union, wholly or in part with-
in his county, his precept in a prescribed form,
with copies of the lists of registered voters and
forms for returns of rated occupiers. The 17tb
section prescribes the duty of Clerks of unions in
relation to the lists for the year 1850 ; viz., to
make out and transmit the required list of occu-
piers rated on a net annual value of XI 2, or up-
wards ; omitting those owing an arrear of rate,
and setting a mark against those who are believed
-to be not entitled to be placed on the register.
The 18th section requires the Clerk of the Peace
in the year 1850 to frame a supplemental list
&om the returns so made to him by the Clerks of
unions, and to annex same to the existing list of
registered voters.]

fifty-one, to any Clerk of the union or other
officer having the custody of any poor rate book,
to inspect such poor rate book, and make extracts
therefrom, for any purpose relating to any claim
or objection made or intended to be made by or
against such person ; and every such Clerk of the
union or other officer as aforesaid is hereby re-
quired, upon such request as aforesaid, to permit
such inspection and the making of such extracts,
without payment of any fee.

[§ 28, 29, and 30 relate to the duties of Clerks
of the Peace and Town Clerks, in regard to the
formation of the register of borough voters and
the preparation of the lists.]

31. And be it ena<jted, That the Town Clerk of
every such city, town, or borough, for his assist-
ance in making out the list of voters as herein-after
mentioned, (upon request made by him at any
time between the hours of ten of the dock in the
forenoon and four of the clock in the afternoon of
any day, except Stunday, between the sixteenth
day of Jvme and the twentieth day of Jul^ in every
year after one thousand eight hundred and fifty-
one, to any Collector of poor rates, or to any other
officer having the custody of any such t2A» or rate
book,) shall have free liberty to inspect the same,
and to extract such particulars as may appear to
such Town Clerk to be necessary ; and every Col-
lector of poor rates of premises within such cify,
town, oar borough, or officer having the custody of
the rate books relating to the same, shall (if re-
quired by the Town Clerk) within four days after
the first day of Jtdy in every year after one
thousand eight hundred and fifty-one, make out
and deliver to the said Town Clerk a list contain-
ing the name and place of abode of every person

ments, or hereditaments, situated as aforesaid, of
a net annual value of such an amount as when
divided by the number of occupiers would give to
each such occupier a net annual value of eight
pounds* or upwards, excluding nevertheless fi^m

poor lutes (if any) which shall have become pay-
