RESOLVE OF LEGISLATURE



IN RELATION TO THE EARLY YORK DEEDS,



Resolved, That the Maine Genealogical Society, agreeing
to supervise the copying, attesting, editing, indexing and
publishing of volumes tAvelve and thirteen of the public
records of this state in the office of the register of deeds for
York county, in the same manner as the eleven preceding
volumes already published, except that, on account of their
increased size, they arc not re()uired to be leaded, nor to
have the tabular index, the governor and council shall })ur-
chase for the state four hundred and fifty copies of each
volume at five dollars per volume ; and the state librarian
shall cause one co})y of each volume to be placed in each
registry of deeds in this state ; the remaining co})ies to be
distributed or exchanged at the discretion of said librarian.

James Foye Couiity of York Send Greeting know ye that I
Nath"H?xs ^^^ ^'' James Foye as well for & in Considera-
tion of the natural Affection & Love I hear to
my Son in Law Nathaniel Hixs & in Consideration hath
married my Daughter as also for divers others good Causes
& Considerations me at this Present especially movino- have
given granted & by these Presents do give grant & confirm
unto the s'* Nathaniel Hixs & my Daughter during their
natural Life two Acres of Land situating & lying in Kittery
Town & near the Creek going to Brave boat Harl)our & on
the Eastern Side of s'' Foyes now dwelling House & bounded
upon the Eastern Side by the Creek And upon the North
Side & West Side & South Side of s'' Foyes Land To have
& To hold the s^^ Land to the s^' Nathaniel Hixs & Martha
Hixs his Wife & to their Heirs for ever lawfully born of
her Body to their own proper Use & Behoof for ever freely
& quietly without any Manner of Challenge Claim oi" De-
mand of me the s'' James Foye or of any other pson or
persons whatsoever for me in my Name by my Cause Means
or Procurement & without any. Money or other Thing thoj-e-

for & in y" Consideration of certain Pay to us in Hand Paid
have bargained & sold & do by these Presents bargain &
Sell unto Nicholas Cole & John Puringtan all the Land
layino- & being between the two Carrying Places upon Mer-
ecanneg beginning at y^ Head of y*= Westermost I5ranch of
Wiggen Cove so directly over to y*" Wester Bay to y® Bight
& so up along y'' Neck from side to side untill they come
to ye uppermost Carrying Place at y*^ Head of y" Wester

To of Essex within his Majesty's Province of the

NathHHix Massachusetts Bay in New England Shipwright
have for &. in Consideration of the Sum of Sixty Pounds
Curr^ Money of afores'' to me Hand well & truly paid be-
fore the Signing & Sealing hereof by Nathan" Hix of Kittery
in the County of York within the Province afores'' Ship-
wright the Receipt whereof to full Content & Satisfaction I
do hereby acknowledge & my Self therewith fully satisfied
contented & paid & thereof & of every Part & Parcel thereof
do exonerate acquit & discharge the s'^ Nathan'^ Hix his
Heirs & Assigns for ever have oiven granted baroained &
sold & do by these Presents fully freely & absolutely give
grant bargain & sell unto the s'' Nathan" Hix his Heirs Ex-
ec""^ Adm" & Assigns for ever One Messuage or Tract of
Land [2] And Meadow Lying & being in the Town of Kit-
tery afores'^ containing by Estimation twenty Acres be the
same more or less It being all that Tract of Land that was
formerly laid out by Virtue of a Town Grant to my Father
Joseph Couch formerly of Kittery afores'' deceas'' as ai)pears
p a Return under the Surveyers Hand of the said Town of
Kittery bearing Date the 19*'' Day of July 1694 bounded
viz' on the North by the Town Comons on the East by the
Land formerly Dennis Hix on the West by the Land of
Robert Mitchels & on the South by the Land of William
Peppei-rell To have & to hold the s'' twenty Acres of Land
together with all the Timber Trees, Priviledges Comodities
& Appurtenances to the same belonging or in any ways
appertaining to him the s'' Nathaniel Hix his Heirs & Assigns
for ever To his & their only proper Use Benefit & Behoof
forever And I the s'' W*" Couch before the Signing & Seal-
ing hereof do avouch my self to be the true sole & lawful
Owner of the above granted & bargained Premisses & have
in my self good Right full Power & lawful Authority to
give grant bargain sell aliene convey & confirm the afores'
granted & bargained Premisses in Manner as afores'' And
that the s'' Nath" Hix shall & may from Time to Time & at
all Times for ever hereafter by Force & Virtue of these
Presents lawfully peaceably & quietly have hold use occupy
possess & enjoy all the afore granted & bargained Premisses
as afores'' And that the same is free & clear of all & every
Incumbrance or Incumbrances whatsoever — Furthermore I

in the County of York in the Province of the Massachusetts
Bay in Xew England Joyner for & in Consideration of the
Sum of four Pounds in good Bills of Credit on the afores''
Province to him in Hand paid before the Delivery hereof
The Receipt Whereof he doth hereby acknowledged, hath
remised released & for ever quitclamied & by these Presents
for himself & his Heirs doth fully freely & absolutely remise
release & for ever quitclaim unto Xathaniel Hix of the same
Place Shipwright in his full & peaceable Possession & Seizin
& to his Heirs & Assigns for ever all such Right Estate Ti-
tle Interest & Demand whatsoever as He the s"* John Xorton
had or ought to have in or to all or any Part of a certain
twenty Acres of Land situate lying & being in the Town-
ship of Kittery afores'' by any Ways or ^Nleans whatsoever
which was granted & laid out to Joseph Couch formerly of
Kittery deceas*' & is butted & bounded as followeth that is

to say beginning at Col° William Pepperrells Head Line of
his Land and running by the s*^ Line on an East & by South
Course from Robert Mitchels Laud unto Denn-is Hix's Land
& then running up into the Woods between the s' Robert
Mitchels & Dennis Hix's Land to the New laid out Town
Comons having Robert ^litchels on the AVest & Dennis
Hixs Land on the East To have & to hold the s'^ Land &
every Part of it unto the s*^ Xathauiel Hix his Heirs & As-
signs & to the only use & behoof of the s"^ Xathaniel Hix
his Heirs & Assigns for ever — So that neither he the s'^
John Xortou nor any other Person or Persons from him or
them or in his or their Xames or in the Xame Right or
Stead of any of them shall or will by any Way or Means
hereafter have challenge or Demand any Estate Right Title
or Interest of in or to the Premisses or any Part or Parcell
thereof But from all & everv Action Right Estate Title In-
terest or Demand of in or to the Premisses or anv Part &
Parcell thereof the}' & ever\' of them shall be utterly ex-

"^ To*^ the County of York in his Majesties Province of

Jos: Houit the Massachusetts Bay in Xew England Cord-
wainer & Deborah his Wife she being the only surviving
Child of Benjamin Donnel late of York deceased for & in
Consideration of One Deed of Quitclaim & a General Re-
lease bearing even Date with these Presents signed & Sealed
by Joseph Hoult of s' York Yeoman & Mary his Wife &

delivered to the s'' William & Deborah Duning have remised
released & for ever quitclaimed & by these Presents do
remise release & for ever quitclaim unto the s'^ Joseph &
Mary Hoult their Heirs & Assigns in their full & Peaceable
Possession [3] All such Right^Estate Title Interest & De-
mand whatsoever as they the s'^ William & Deborah Duning
had or ought to have in or to all that Land which formerly
was in the Possession of Thomas Donnel the Father of the
s'' Benjamin Donnell : t^ Andrew Averett deceased & now
improved by John & Nathaniel Donnell Sons of the s''
Thomas Donnell lying on the North East Side of York River
as also all the Land lying ow the South West Side of s'' York
River excepting forty Acres released to the s'^ William Dun-
ing & Deborah his Wife by the Deed above mentioned & a
Piece of Marsh on the South West Branch of s" York River
also quitclaimed therein — likewise s'^ Duning & his Wife
Deborah do acquit to s" Hoult & his Wife all their Right to
any Piece of Marsh lying on the North West Branch of s''
York River which was owned by s'^ Thomas Donnell together
with the Priviledges Profits & Comodities to the s'' Land &
Marsh belonging — To have and to hold the s'' Land &
Marsh & Premisses to the s^ Joseph Hoult & Mary his Wife
& his Heirs & Assigns for ever so that they the s'^ William
Duning & Deborah his Wife nor their Heirs nor any other
Person for him or them or in his or their Names or in the
Name Right or Stead of any of them shall or will by any
way or Means have claim challenge or demand any Estate
Right Title or Interest of in or to the Premisses or any
Part or Parcel 1 thereof except as before excepted ; But from
all & every Action Right Estate Title Interest or Demand
of in or to the Premisses or any Part or Parcell thereof they
& every of them shall be utterly excluded & barred for ever
by these Presents And also the said William Duning &
Deborah his Wife the above demised Premisses to the s^'
Joseph Hoult & Mary his Wife to his & their proper Use &
Uses in Manner & Form aforespecified against their Heirs

two hundred pounds in good & Lawful Money of the Pro-
vince afores'^ to me in Hand before the Ensealing hereof
well & truly paid by William Pepperrell of Kittery afores^^
Esqr the Receipt whereof I do hereby acknowledge & my
self therewith fully satisfied & contented & thereof & of
every Part & Parcell thereof do exonerate acquit & Dis-
charge the s'^ AVilliam Pe[)perrell his Heirs Exec""' Admin''
for ever by these Presents have given granted bargained
sold aliened conveyed & confirmed And by these Pres'* do

promise & grant to & with the s'^ William Pepperrell his

Cole of Wells afores*^ Millwright have given & granted &
do by these Presents for our selves our Heirs Exec''* &
Adm""* give grant bargain sell alienate enfeoffe & confirm to
Nicholas Cole afores'' all our Right Title Property & Privi-
ledge to one hundred Acres of Land near to little River
great Falls & ten Acres of Marsh or fresh Meadow which
was granted & given by the Town of Wells at a legal Town
]Meeting unto William Frost & Jonathan Hamond upon
the ninth Da}' of May Anno Domini One thousand six hun-
dred & Eighty two as by s'^ Town Grant may more fully
appear — Excepting three Acres ot Land on the West Side
of the Falls & two on the Eastei'ly Side of the River &
Falls which are reserved for the Use & Priviledge of the
Mill or Mills that is or hereafter May be built on s'' Falls
according to the Tenour of a Letter of Partnership between
AVilliam Frost afores'' & Jonathan Hamond Father in Law
to s'' Samuel Tredwell & Joseph Littlefield Father to aboves''
Joseph Littlefield which Letter of Partnership bears Date
January 23 Anno Domini 1684. The which Part or Interest
of ours unto s'' Hundred Acres of Land & ten Acres of
jNIarsh (excepting what is l)efore excepted) We the s'^ Sam-
uel Tredwell & Joseph Littlefield do make over & confirm
as afores'' unto s'' Nicholas Cole his Heirs Exec''' Admin''' or
