River, Otherwise than is Conformable to to Our Royall Instruc-
tions as by a Certificate Under their Hands Bearing date the
Ninth Day of June instant, Entred of Record in Our Secretary's
office for Our Province of New York fully & at Large appears
AND WHEREAS The Said Charles Boyle By another Petition
Presented Unto Our Said Captain Generall In our Said Councill
of New York upon the Twenty fourth Day of June in this fifth
Year of Our Reign, did Sett forth, That by the Setting out of
the Lands whereof the Said Newman Died Seized In Severaltys
aforesaid the Number of Acres Which they Contain is Ascertained
and thereby the Usuall Quit-Rent to be Paid for the Same is
fixed, but as to the Rights of Land in the Old & New Purchase
of Oyster Bay being Only, A Right in the Common &. Undivided
Lands There which are Scattered up & Down among the Divided
Lands and are Utterly Uncertain as to the Bounds or Quantity
they Contain, It is Therefore Impracticable to Survey the Same
or to Exactly ascertain, what Number of Acres Such Common
Lands Contain Nor how many Acres thereof Do exactly belong to
a Right but by the Best Information That our Said Petitioner
Could obtain, All the undivided Lands which belong to the Said
Rights would not amount to One Hundred Acres, Yet Neverthe-
less the Said Charles Boyle by his Said Petition Did ofifer to
allow the Usuall Quit Rent for two Hundred Acres, So that We,
our Heirs and Successors might have the full Quit Rent Yearly
for the Same AND therefore humbly Prayed that the Quit Rent
for the Said Rights might be Ascertained in Our Letters Patent
at five Shillings per Annum being the Usuall Quit rent of two

Hundred Acres WHICH PETITION was upon the Said Twenty
fourth Day of June Read In our Said Councill of Our Said Pro-
vince of New-York AND it was then Referred to a Committee
of our Said Councill to Consider, & to Report their Opinion to
that Board, which Committee afterwards upon the Same twenty
fourth Day of June Did accordingly report. That they had Duly
weighed & Considered of the Matters in the Said Petition Sett
forth & were of Opinion that Our Said Captain Generall, might
Grant the Prayer thereof, which Report was then and there ap-
proved of by our Said Councill & there upon the Same Our Coun-
cil Did humbly advise Our Said Captain Generall & Consent that
the Prayer of the Said Last Mentioned Petition, Should be
Granted as by the Same Last Petition & Proceedings in Our Said
Councill thereon fully & at Large Doth Appear NOW KNOW
YE That we being willing to Grant to the Said Charles Boyle
and to his Heirs & Assigns, the Severall Tracts of Land aforesaid
and the Rights of Lands & Tenements whereof the Said John
Newman Died Seized in Severalty and in Common as well in
Consideration of the Great Charge the Said Charles Boyle has
been at in making the Discovery of the Said Lands & in Consid-
eration of His having paid fully the whole Charge of the In-
quisitions aforesaid amounting to a Considarable Summ of Money
as also of the Benefit that we & our Heirs & Successors may reap
by the Rents & Services herein after reserved, and that others may
be hereby encouraged to Discover our Rights when concealed
and In Consideration of the other Matters In the Said Petitions
Sett forth WE of Our especiall Grace Certain Knowledge & Meer
Motion HAVE Given Granted ratified & Confirmed and DO by
these Presents Give Grant ratify & Confirm unto the the {sic) —

& Assigns ALL & every the Severall Tracts aforesaid whereof
the Said John Newman Died Seized as aforesaid, in Severalty
as the Same are herein before Described Butted & Bounded

whereof the Said John Newman Died Seized or entitled unto in
the Township of Oysterbay In Queen's County upon Nassau
Island aforesaid, Either In the Old or New Purchase by Virtue
of the Rights which the Said John Newman, had or ought to have
had In & to the Shares & Parts in the Common & Undivided Lands
there TOGETHER with all & Singular the Woods, Underwoods,
Trees Timbers feedings Pastures Meadows Marshes Swamps
Ponds Pools Waters Water Courses, Rivers Rivulets, Runs &
Streams of Water Fishings Fowlings, Hunting & Hawking
Houses Barns Stables Gardens Orchards Fences Improvements
Mines & Mineralls (Except Gold Mines & Silver Mines) Stand-
ing Growing being or Lying or to be found had used & enjoyed
in upon or within the above Granted Premises or any Part thereof

And all other Profits benefits Libertys, Priviledges Hereditaments
& Appurtenances to the Same belonging or in any wise appertain-
ing & all our Estate Right Title, Interest benefit Claim & Demand
Whatsoever of in or to the Same And the Reversion and Rever-
sions Remainder & Remainders Rents & Arrears of Rents, Yearly
& other Profits of the Same, Except also & always reserved out
of this Our Present Grant Unto Us Our Heirs & Successors for
Ever ALL Trees of the Diameter of twenty four Inches and
Upwards at twelve Inches from the Ground for Masts for Our
Royall Navy & also all such other Trees, as may be fitt to make
Planks, Knees & other things Necessary for the Use of Our Said
Navy, only which now are Standing Growing or being, or at any
time hereafter shall be Standing Growing or Being in or Upon
the above Granted Lands or any Part thereof with free Liberty
& Licence for any Person or Persons whatsoever by us Our
Heirs or Successors or any of them to be thereunto Especially
Appointed under Our or Their Sign Manuall either with or with-
out Workmen Horses Waggons Carts or any other Carriages to
Enter & Come into & upon the Said Lands & Every or any Part
thereof And there to fall Cutt Down Root up Hew Square Saw
work up have take & carry away the Same for the Uses aforesaid,
TO HAVE AND TO HOLD all & Singular the above Granted
Lands and Premises as well Divided as in Common, with all &
Every Their & Every of Their {sic} Hereditaments & Appurten-
ances (Except as before is Excepted & Reserved^J) Unto the
Said Charles Boyle His Heirs & Assigns to the Sole & only
Proper Use Benefit & Behoof of the Said Charles Boyle & of His
Heirs & Assignes for Ever YEILDING RENDRING & Paying
therefore Yearly & every Year for Ever Unto Us Our Heirs and
Successours at our Custom House In the City of New- York,
Unto Our or Their Collector and Receiver Generall for the time
being (on the Annunciation of the Blessed Virgin Mary Com-
monly Called Lady Day The Annual-rent of two shillings &
Six Pence for Every Hundred Acres of the Lands Butted and
Bounded as aforesaid and So in Proportion for any Lesser Quan-
tity thereof And also the Summ of Five shillings for the Common
and Undivided Lands appertaining to the Rights, whereof the
Said John Newman Died Seized and So entitled to as is above
expressed in Lieu & Stead of all other Rents Services Dues Dutys
and Demands whatsoever for the above Granted Lands Heredita-
ments & Premises PROVIDED ALWAYS That in Case It
should hereafter appear the the Undivided Lands hereby Granted,
should amount to more than two hundred Acres Then & in that
Case The Said Charles Boyle His Heirs & Assigns Shall not only
Pay thence forwards the Annual-rent of two shillings & Six pence
for every hundred Acres, that the Same now undivided Lands
Shall appear to Contain (and so in proportion for whatever Acres

the Same Do Contain, but also shall pay all Arrears thereof
from the Date hereof beyond the Said five shillings per Annum
herein before reserved & Yearly payable for the Same PRO-
VIDED ALSO, & these Presents are upon this Condition That
if the Said Charles Boyle his Heirs & Assigns Some or one of
them shall not within the Space of three Years next ensuing the
Date hereof Plant Settle & effectually Cultivate at Least three
Acres of Every fifty Acres of the above Granted Lands which
are yet uncultivated or if the Said Charles Boyle his Heirs or
Assigns or any other Person or Persons by Their or any of Their
Privitys Consent or Procurement, shall Sett on fire or burn the
Woods on the Said Lands or or {sic) any part thereof, to Clear
the Same So as to Destroy Impair or Hinder the Growth of any
of the trees That are or may be fitt for Masts Planks Knees or
other Timber fitt for the Use of Our Royall Navy hereby re-
served unto Us our Heirs & Successors, That then & in Eithir
of these Cases, This our Present Grant & everything herein Con-
tained shall Cease end & Determine & be Utterly Void & of none
Effect Any thing herein before Contained to the Contrary Not-
withstanding DECLARING Nevertheless That nothing in These
Presents, reserved or Contained, Shall or Ought to be Construed
To — Turn over — {p. 48) — To Extend or be Intended to Prohibite
or in any wise Hinder The Said Charles Boyle His Heirs or As-
signs from Such Burning of the Woods or Cutting Down of the
Trees, That are or shall be Growing or being on the above Granted
Lands or any Part thereof as Shall be Conducive to the Clearing
& Effectuall Cultivating of the Same Lands or any Part thereof,
or for their own use or Benefit AND We do further Declare
That by the Said Burning of the Woods is only Meant & Intended
That the Said Charles Boyle His Heirs & Assigne are to be Re-
strained Only from Setting fire to & Burning Any Trees or Tim-
ber whilst they are Standing & Growing upon the above Granted
Lands or any Part thereof AND We Do further of Our Especiall
Grace Certain Knowledge & Meer Motion Consent & Agree, That
This Our Present Grant (being Entred on Record as is herein
after Expressed) shall be Good & Effectuall in the Law to all
Intents Constructions & Purposes, Against Us our Heirs & Suc-
cessors Notwithstanding any Misreciting, misbounding or Mis-
naming of the above Granted Lands & Premises or any Part there-
of, IN TESTIMONY whereof We have Caused These Our Let-
ters to be made Patent, & the Great Seall of Our Said Province
to be hereunto Affixed And the Same to be Entred on Record,
in our Said Secretary's office in One of the Books of Patents
