Excell^y declared. That as to what y* Council fay in their Anfwer to y« firft queftion
Viz "That in all Grants of money for the Council to declare their Opinion before y
houfe of Burgeffes give their Anfwer ab' them is Contrary to y* pradtice & proceedings
of Affemblys: His Excell'^ cannot allow any prefcription in this Cotmtry: nor any
Prefid' or Cuftom to take place contrary to the prerogative: but if prefid" could be
admitted; Yet it cannot be made appear that ever there was a parralel Cafe to this

Then his ExceU^y communicated to y* Council two Letters from his Excell^y the
Lord Vif count Cornbury Govern' of New York dated y ii"" June & iq"* November laft
which he intended to lay before y* houfe of Burgeffes & at y* fame time to acquaint the
houfe that if y* Country cannot at prefent advance the money he will lend them fo
much without Intereft

That it doth appear to y houfe that y' Laft houfe of Burgeffes did refufe to give
the Nine htmdred Pounds to New York, not becaufe y Govern' was propofer of it but
for other reafons at large envunerated in y Journal of y« faid houfe. And that the
Report mentioned in his Excell'y" written Meffage of yefterday is a faKe Scandalous
and Malicious Report

uting the Sum of Nine hundred Pounds required for New York.

And that if they concurr they will be pleafed to Joine in a Committee w"* the Burgeffes
to Confider of the beft methods to reprefent our Circumftances of inability to her Ma"'

York, The Council will do well to confider the State of y' Country & to enquire into the
Publick Aco"=, for y' his Excell'^'' is Satisfied there is nigh half of that Money now in
Bank, after dedudlion of all debts that Fund is now Charged w"* & as for y« remainder
his Excel^y will advance it, or if Neceffary the whole upon the credit of thofe impofition

they are of Opinion in regard the Place Appropriated for that ufe is not finifhed nor
any ways as yet made Convenient to Receive them that they remaine here [where]
they now are til Such time as the Same be finifhed or made Sufficient to fecure them
from danger

Vpon Confideracon of the Peticons of Sev" Perfons to be Goal keeper of y Country
Prifon & to look after & take care of y' Capitol & the furniture &c belonging to it when
they Shall be finifhed It is the Opinion of the Com'« that Jn° Redwood is the moft fit

His Excel^y laid before y Council her Matys Royal Letter relating to the Quota
of men & money reqtiired by her Maty for the affiftance of New York & acquainted
them that Since the houfe of Burgeffes had now given their anfwer on y* faid Letter
he recommended to the Council as the Upper houfe of Affembly to confider of her
Matys f"* Commands & give him their anfwer thereon

Whereupon the Council took y* Same immediatly into Confideracon and a debate
arifing the quef tion was put whether the Council fhall make their Anfwer by an Addref s
to her Maty diredlly or by an Addrefs to his Excel^y w* a requeft to him to reprefent
their Cafe to her Maty It was thereupon
