Whereas att the last Prouinciall Court holden att S' Marys for
this prouince 8'^ Septemb"" last, The next Pi^ouinciall Court was then
appointed to bee held on the Second Twesday in Decemb"" following
Being the 8'^ day thereof. Now for as much as the houlding of that
Court on that day appointed will proue uery inconuinient by reason
Ip- 134] ^^ ^^^ p''sent distemper now reigning in the Country, These are
therefore to giue notice to all p''sons whom it may Concerne That I
haue adjourned the said Court to be held on the Eigth day of De-
cemb'' as aforesaid untill the second Tuesday in February next being
the 9* day thereof, And all writts and other Process issued for that
Court intended to bee holden on the 8*^ of Decemb"" shall bee return-

of the purchase was thereby forced to Expose himselfe to Great Cost
hazard & trouble in goeing downe to Virginia to p''cure the Euidence
of Certaine p''sons to euade the false Allegations & Accusacons of
the defend* in his said Peticon menconed and when the Cause come
to fifull tryall by a Jury Cozen for that end they found for the plan-
tifife and that the defendant should serue the plan^^ untill the defend'
were twenty one yeares of age by the Law of this Country adjudg-
ing him then to bee nineteene yeares old being the S'*' Octob'' i66l
as will appeare by the Records, Wherefore the plantiffe Sayth in Fact

County, to Receiue and Collect some ffees to the ualew of fiue thow-
sand pounds of tob: or upwards. And it probably appearing (by
seuerall Receipts and acquittances giuen by the said Sadleir) that
hee the said Sadlier did receiue either all or the greatest part of the [p. 135]
said sum and neuer became accomptable unto yo"" Pef for aboue two
hhgs of tob: (as euidently can appeare) making use of the rest for
his owne Occasiones to yo"" Pef^ greate disaduantage & damage as

Cask, by an Ingagem* under his hand & seale Bearing date th^ 29*^
of August 1663 & due to bee payd in Octob'' last, W'^'^ when this En-
gagem* was signed, hee promised to acknowledge it in Court, W'^''
yo"" Pef demanded many times, & hee refuses it, The humble request
of yo'' Pef" is That th^ s*^ Jolley may bee ordered forthw*^ to pay th^
Tob. or putt in good security for p''nt paym'^ or uppon default th*
